Since Kindly, Inc. ("Company", "we", "us", or "our") operates ASA Agent ("the Service"). This Privacy Policy describes how we collect, use, store, and share information when you use the Service. By using the Service, you agree to the practices described in this policy.

1. Information We Collect

Account Information: When you create an account, we collect your name, email address, and authentication credentials provided through third-party sign-in services (such as Google).

Apple Search Ads Credentials: We collect and store the API credentials you provide to connect your Apple Search Ads account, including client ID, team ID, key ID, and private keys. These are stored encrypted and are used solely to manage your campaigns.

App Store Connect Credentials: If provided, we collect App Store Connect API credentials for performance reporting. These are stored encrypted.

Campaign Data: We collect and store campaign performance data from your Apple Search Ads account, including impressions, taps, installs, spend, keyword metrics, and related analytics.

SDK Data: If you integrate the ASA Agent iOS SDK into your app, we may collect: a randomly generated device identifier (not tied to personal identity), Apple AdServices attribution tokens, in-app purchase and subscription events (product ID, revenue amount, transaction ID), app version, OS version, and SDK version. The SDK does not collect names, email addresses, phone numbers, precise location, or any data that directly identifies an individual.

Usage Data: We automatically collect information about how you interact with the Service, including pages visited, features used, and browser type.

2. How We Use Your Information

We use the collected information to:

  • Provide, operate, and maintain the Service.
  • Manage your Apple Search Ads campaigns as authorized by you.
  • Attribute app installs to advertising keywords and campaigns.
  • Generate performance reports and analytics.
  • Process payments and manage subscriptions.
  • Send service-related notifications and alerts.
  • Improve and develop new features for the Service.
  • Detect and prevent fraud or abuse.

3. Data Sharing

We do not sell, rent, or trade your personal information to third parties. We may share information with: (a) service providers who assist us in operating the Service (such as cloud hosting, payment processing, and analytics), subject to confidentiality obligations; (b) Apple, to the extent necessary to manage your Apple Search Ads campaigns and resolve AdServices attribution tokens — Apple may independently collect and use data in connection with its Advertising Services in accordance with Apple's Privacy Policy (available at apple.com/privacy); (c) law enforcement or government authorities when required by law or to protect our legal rights; (d) a successor entity in the event of a merger, acquisition, or sale of assets.

Publicity: Subject to our Terms of Service, we may display your app name, icon, and App Store link on our website as a customer reference. Your campaign performance data, metrics, and results are treated as confidential and will not be publicly disclosed without your separate, explicit, written consent. You may opt out of the publicity use at any time by contacting us at support@asaagent.xyz.

4. Data Security

We implement commercially reasonable technical and organizational measures to protect your data, including encryption of credentials at rest and in transit. However, no method of transmission over the Internet or electronic storage is 100% secure. We cannot guarantee absolute security, and you acknowledge that you provide information at your own risk.

5. Data Retention

We retain your account information and campaign data for as long as your account is active or as needed to provide the Service. Upon account deletion, we will delete or anonymize your data within 90 days, except where retention is required by law or for legitimate business purposes (such as resolving disputes or enforcing our Terms). SDK attribution and revenue data may be retained in aggregated, non-identifiable form for analytics purposes. Please note that Apple may independently retain data relating to your use of Apple Search Ads, your account, and your campaigns in accordance with Apple's own data retention policies and applicable laws.

6. Your Rights

Depending on your jurisdiction, you may have the right to:

  • Access the personal data we hold about you.
  • Request correction of inaccurate data.
  • Request deletion of your data.
  • Object to or restrict processing of your data.
  • Request data portability.
  • Withdraw consent at any time.

7. iOS SDK and End-User Privacy

If you integrate the ASA Agent iOS SDK into your application, you are the data controller for any data collected from your end users through the SDK. You are solely responsible for: (a) providing appropriate privacy disclosures to your end users; (b) obtaining any required consents for data collection (including compliance with GDPR, CCPA, and Apple's App Tracking Transparency requirements); (c) including SDK data collection in your app's privacy policy and App Store privacy nutrition labels. We act as a data processor on your behalf for SDK-collected data and will process it only as instructed by you through your use of the Service.

8. Cookies and Tracking

The Service uses essential cookies for authentication and session management. We do not use advertising cookies or third-party tracking pixels. We may use basic analytics tools to understand Service usage patterns.

9. International Data Transfers

Your data may be transferred to and processed in the United States or other countries where our service providers operate. By using the Service, you consent to such transfers. We take commercially reasonable steps to ensure that data transfers comply with applicable data protection laws.

10. Children's Privacy

The Service is not intended for use by anyone under the age of 18. We do not knowingly collect personal information from children. If we become aware that we have collected data from a child, we will take steps to delete it.

11. Changes to This Policy

We may update this Privacy Policy from time to time. We will notify you of material changes by posting the updated policy on this page with a revised "Last updated" date. Your continued use of the Service after such changes constitutes acceptance of the updated policy.
